Cruz-Perez Bill to Provide Immunity of Liability for Rescuing Animals from Motor Vehicles Under Inhumane Conditions Advances

TRENTON – A bill sponsored by Senate Economic Growth Chair Nilsa Cruz-Perez providing immunity from criminal and civil liability for someone who breaks and enters a vehicle to rescue an animal under inhumane conditions was approved by the Senate Economic Growth Committee today. 

“Those that spring into action to save animals locked inside dangerously hot unattended vehicles should not be punished for their heroic deed” said Senator Cruz-Perez (D-Camden/ Gloucester).  “This protection will make more people act.  It is imperative for people to intervene without having to fear legal consequences.”

The bill, S-1860, protects persons acting in good faith to rescue an animal reasonably believed to have been left unattended in a vehicle under inhumane conditions adverse to the health or welfare of the animal.  That person would be required first to report the circumstances of the rescue and make a reasonable effort to locate the owner of the vehicle before they break in.

This bill was released from committee by a 5-0 vote.  It next moves to the full Senate for further consideration.
